1. About Evermemory
Evermemory creates personalized artwork and products designed to help you celebrate, preserve, and cherish the people, pets, and moments that matter most.
Throughout these Terms, “Evermemory,” “we,” “us,” and “our” refer to Evermemory Studio.
2. Personalized Products
Many of our products are custom-made using the photos, names, dates, messages, and other information you provide.
You are responsible for ensuring that all submitted information—including photos, names, dates, and personalization details—is accurate before placing your order.
Because personalized products are created specifically for each customer, they cannot be returned or exchanged simply because you change your mind, select the wrong size, or provide incorrect information.
3. Artwork Preview & Approval
For products that include a custom artwork preview, our designers will create a digital preview using the information and images you provide.
You will receive your preview within 24 hours for review and approval. You may request revisions before the artwork is sent to production.
If we do not receive a response within 48 hours, we may proceed with production using the latest design to avoid unnecessary delays.
Once an order has entered production, changes and cancellations may no longer be possible.
4. Customer-Provided Photos & Content
By uploading a photo or other content, you confirm that you have the right to use and reproduce that content for the purpose of creating your order.
You agree not to upload content that:
- You do not have permission to use
- Violates another person's copyright or intellectual property rights
- Contains unlawful or abusive material
- Violates applicable laws or regulations
Evermemory reserves the right to refuse an order containing content that we believe is inappropriate, unlawful, or violates the rights of others.
5. Product Colors & Appearance
We make every effort to display our products and artwork as accurately as possible. However, colors may vary slightly between your screen and the final printed product due to differences in monitors, displays, lighting, and printing processes.
Minor variations in color, texture, and positioning may occur during the printing and production process.
6. Orders & Payments
All orders must be paid in full before production begins.
By placing an order, you authorize us to charge your selected payment method for the total amount shown at checkout.
We reserve the right to cancel or refuse an order when necessary, including in cases of suspected fraud, payment issues, or inaccurate product information.
7. Production & Shipping
Personalized products require time for artwork creation, approval, production, and shipping.
Estimated delivery times are provided as a guide and may vary due to production schedules, carrier delays, weather, holidays, or circumstances beyond our control.
Once an order has been shipped, tracking information may be provided when available.
8. Damaged or Defective Products
If your product arrives damaged, defective, or with a printing or manufacturing issue, please contact us within 30 days of delivery.
We may request photos of the product and packaging to evaluate the issue. If the issue is confirmed, we will provide a replacement at no additional cost.

9. Intellectual Property
All website content, including our branding, logos, graphics, product designs, photographs, and original artwork, is owned by or licensed to Evermemory and is protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, or use our content for commercial purposes without our written permission.
10. Use of Our Website
You agree to use our website only for lawful purposes.
You may not attempt to interfere with the operation or security of our website, gain unauthorized access to accounts or systems, or use our website in a way that could harm Evermemory or other customers.
11. Third-Party Services
Our website may use third-party services for payment processing, website functionality, production, shipping, analytics, or other business operations.
These services may have their own terms and privacy policies. Evermemory is not responsible for the policies or practices of third-party providers.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Evermemory will not be responsible for indirect, incidental, special, or consequential losses arising from your use of our website or products.
Our liability relating to an order will generally be limited to the amount you paid for that order, except where a greater limitation is prohibited by law.

We may update these Terms of Service from time to time to reflect changes to our business, website, products, or legal requirements.
